　　2008年起至2013年上半年案发期间，杨秋海任吉安市工业和信息化委员会节能与资源综合利用科科长，负责对全市工业企业节能补贴项目进行申报和审核。据吉安市吉州区人民检察院指控，2008年5月，吉安市青原区青建新型建材有限公司杨某得知国家有节能技改补贴资金，便找到杨秋海，想以“窑炉改造”的名义申报国家节能技改补贴。在杨某许以好处后，杨秋海告诉杨某如何将不符合申报条件的公司利用虚假数据重新包装申报项目。随后，杨秋海又利用职务之便帮助杨某通过申报，顺利获得国家节能技改项目补贴资金600万元。

　　据办案检察官介绍，在非法套取第一笔补贴资金后至案发时近5年间，杨秋海利用职务便利，先后帮杨某将5个不符合条件的公司以“窑炉改造”“余热烘干”“节能技改”等名目，采取虚报产能、虚增节能量、虚降能耗的手段，共非法套取国家节能补贴3100余万元。在此期间，杨秋海共受贿24笔，受贿金额280万元。受贿款中除一部分返借给杨某“吃利息”外，其余分别以35%、16%、5%的股份，投到杨某的三个公司里，其中从吉安市吉州区宏宇新型建材有限公司分红4次，获利90余万元。

　　法院审理认为，鉴于杨秋海认罪态度较好，退出了全部赃款，并且有立功表现，遂作出上述判决。目前，行贿人杨某正在等待法院的审判。
