12月21日消息，百度诉360恶意篡改百度搜索页面、劫持流量案日前在北京市高级人民法院做出终审判决，判决维持一审原判，360不正当竞争行为成立，赔偿百度40万元，不得上诉。

2012年初，百度指控360未经允许恶意标注百度搜索结果、篡改百度搜索结果页面，并向用户宣传及误导用户安装其浏览器，为360浏览器导流。此外还表示360利用浏览器捆绑其网址导航站，故意仿冒、混淆百度搜索结果，劫持百度流量。随即百度将360诉上法庭。

今年4月，北京市第一中级人民法院一审判决360不正当竞争行为成立，赔偿百度经济损失及相关支出费用共计45万元，并在其网站首页连续15天刊载道歉声明。针对一审判决结果，360提出上诉，并辩称“一审法院在不了解安全软件工作原理的情况下作出错误认定”，在网站上标注“安全标识”是安全软件的使命，出于“用户需求”。

9月4日，在二审庭审现场，360方面曾主动提出和解，但百度方面并未接受。据了解，在12月17日的二审最终判决书中，法院方面认定“奇虎公司干扰他人互联网产品或服务的正常运行，并非出于保护公共利益的目的，也不产生保护公共利益的效果，维持一审原判，赔偿百度40万元，不得上诉。”

判决书中明确指出，除了恶意标注百度搜索结果外，奇虎公司还篡改了百度搜索框的搜索结果。包括：奇虎公司在用户设置其他搜索方向的情况下插入与用户设置的搜索方向关联性很小的下拉提示词；引导用户访问本不在相关关键字搜索结果中靠前位置的、甚至与用户搜索目的完全不同的奇虎公司经营的影视、游戏等页面；点击奇虎公司设置的下拉提示词，不进入百度搜索结果页面，直接进入奇虎公司经营的影视、游戏等页面。

判决书认定，奇虎公司的行为不仅干扰了网络用户对百度搜索的正常使用，还减少了使用百度搜索框的网络用户对百度搜索结果网页的访问，构成了不正当竞争。
