　　中新网昆明12月17日电 (王艳龙) 17日，昆明市中级人民法院对东川“牛奶河”案作出二审判决。上诉人马世祥被认定为有悔罪认罪表现，改判其犯污染环境罪，判处有期徒刑一年零三个月，缓刑二年零六个月，并处罚金六万元。

　　昆明市东川区小江流域属金沙江一级支流，因为严重污染呈白色，被外界称为“牛奶河”。今年4月，媒体对“牛奶河”进行了报道，引发舆论关注。随后，昆明市对小江污染一事进行调查。经查，“牛奶河”涉及的45家选矿企业中有34家存在手续不全或污染治理设施不完善的问题。其中，昆明东海矿业公司、昆明东川通宇选矿厂、昆明兆鑫矿业公司等5家企业存在私设暗管、环保配套设施未完善就私自投入生产等违法行为，致使未经处理的尾矿浆排入小江，导致污染。昆明市东川通宇选矿厂、昆明兆鑫矿业有限公司、昆明东海矿业有限公司涉嫌污染环境罪，三家企业的法定代表人及相关责任人马世祥等8人被捕，并移交起诉。

　　寻甸县法院开庭审理后于11月18日作出一审判决。昆明东海矿业公司、昆明东川通宇选矿厂、昆明兆鑫矿业公司3被告单位均构成污染环境罪，被处予50万元至75万元不等的罚金，8名责任人中有7人因罪获不同程度有期徒刑。

　　宣判后，马世祥不服，提出上诉，要求昆明中院在维持一审定罪、刑期和罚金的基础上，对其改判缓刑。

　　12月11日，昆明中院公开审理马世祥上诉案，依法确认一审认定的案件事实。查明一审开庭后，马世祥及时向一审法院提交了一份书面的认罪说明；二审前，马世祥及该案原审被告单位东海矿业公司、原审被告人李兴平主动向一审法院交纳了单位罚金、个人罚金共计人民币85万元。同时，马世祥还自愿交纳了环境污染救济专项资金人民币10万元。

　　昆明中院经审理认为，马世祥已经深刻认识到其公司及个人的犯罪行为给当地环境造成的严重破坏和给社会带来的严重危害，表明其具有良好的认罪悔罪表现，符合我国刑法关于缓刑适用的法定条件，依法可对其适用缓刑。

　　17日，昆明中院依法作出终审判决，维持寻甸县法院对东海公司和李兴平的定罪量刑；改判马世祥犯污染环境罪，判处有期徒刑一年零三个月，缓刑二年零六个月，并处罚金人民币六万元，其余维持原判。

　　此前一审中，法庭依法对认罪态度好，有悔罪表现的被告人罗兴华、刘兴奎、张勇、王兴明、马本华判处八个月至一年二个月的有期徒刑，适用缓刑，并处罚金；对任职时间仅6个月，认罪悔罪表现较好，犯罪情节轻微的被告人张建良免予刑事处罚。(完)
