　　2001年8月2日夜，河南平顶山市叶县湾李村一13岁女孩在村北河堤遇害，同村村民李怀亮因当晚曾在案发现场附近经过而成嫌疑对象。8月5日、6日，叶县公安局连续两天对李怀亮留置盘问，8月7日对李怀亮刑事拘留，9月13日李怀亮被逮捕。

　　此后数年间，该案历经七审三判，均因“事实不清，证据不足”被上级法院发回重审。2004年5月，平顶山中院在证据不足、争议较大的情况下，为了避免被害人家属上访，与其约定尽量判李怀亮死刑，该案也因此被称“死刑保证书案”。
