　　新华网上海12月13日新媒体电(记者 黄安琪)上海市长宁区人民法院于12日继续公开开庭审理原告刘光嘉、朱荣周诉被告上海市闵行区人民政府行政强制执行及赔偿案。原告称其在上海市闵行区颛桥镇安乐村的宅基地和承包的鱼塘上所建的私人“盆景奇石博物馆”去年被强迁，官方视频录下了强拆现场政府工作人员“洗劫分赃”的情况，闵行区政府的辩护律师当庭予以驳斥。

　　庭审中，原告播放了其获取的强拆现场的公证视频，称视频中的部分对话证明当日强拆现场存在“洗劫分赃”的情况，且该视频已经过篡改。原告所举的对话包括：“钞票是被派出所拿走的，我们不过是经经手而已”、“不知道你们是否清理光了吗？不然待会我们跑上去就麻烦了”……

　　对此，被告闵行区人民政府代理律师张鹏峰称，这是将被告组织实施强制搬迁过程中由闵行区公证处对被强制搬迁物品的公证证据保全视频、照片进行片段化截取和肆意歪曲，其中的谈话内容都是工作人员为了更好地进行证据保全而说的话。

　　张鹏峰举例说，里面有工作人员提到：“不要把我拍进去”，原告声称这是在“洗劫、分赃”，这实际上就是提醒公证摄像人员，因为本次证据保全的对象是被强制搬迁物品，而不是对人的保全。又比如，工作人员提到：“你让镇里的人好好打包”，原告声称这又是在分赃，但这段视频其实正在拍摄酒柜，对其证据保全，工作人员提醒对于酒类物品要好好打包，以免毁损，这也恰恰是执法适当性的体现。

　　被告方还表示，强制搬迁当天，由内而外的四种因素决定了绝无发生“洗劫、分赃”的可能性：强制搬迁前，警方先行在现场布设了警戒线；警戒线内，闵行区人民法院对整个强制搬迁过程进行现场监督；搬迁现场仅执法人员就超过100多人，同时还有绿化公司、评估公司、搬家公司等非执法人员；警戒线外，还有众多群众围观。

　　而对于视频是否被篡改，张鹏峰表示，2013年12月2日，在法庭主持和双方代理人的参与下，闵行区公证处工作人员专门对公证所采用的摄像机进行了当庭演示，演示结果显示公证处证据保全的公证视频并不存在被剪辑、被篡改的痕迹，双方代理人也对整个演示过程进行了确认，因此公证视频的真实性、完整性和合法性都在预备庭和闵行区公证处提交的书面说明中得到查明和认可。

　　庭审于12日结束，法庭将择日宣判。
