　　昨日，记者从广州市工商局获悉，广州市工商行政管理局会同广州家庭服务业协会共同研究制定了2013版《广州市家政服务合同》和《广州市母婴护理(月嫂)服务合同》示范文本，修改部分实践操作中易引起纠纷的条款，并于即日起在全市推行使用。

　　据悉，此次，新版家政服务合同和月嫂服务合同首次对家政投保金额、月嫂每月工作天数作出规定，对家政服务双方权益“双保险”，其中，合同规定，最低5万最高20万的意外险及保障雇主权益的服务责任险需明文显示投保保额，月嫂每月工作26天应有4天可调配假期。

　　对此，广州家庭服务业协会秘书长莫晓英表示，此前，旧合同条款只规定了购买保险的档次，在家政人员服务出现意外时难以确定赔偿；且并未明文规定月嫂工作天数。“保险保额的规定，不仅保护了家政人员的权益，也保护了雇主。家政人员服务出现意外都可以由保险公司赔偿。以往的档次很难确定赔偿，而现在明确了保额，在事前双方协定好，对雇佣双方的权益保障更有利。而在休息日方面，新版合同则明确了每周休息1天和月底合同结束前休4天两种方式，双方可二选一，计算日薪时也不必因为30天还是26天出现纠纷。”

　　昨日，广州市工商局相关负责人针对合同条款解释为，“例如，雇主与家政企业签订月嫂服务合同，服务时间一个月，月嫂工资6000元，若明年1月15日上岗。因服务时间跨明年春节，有3天国家节假期，如果雇主要求月嫂在这3天里都工作，则雇主每天要支付月嫂日工资的3倍报酬，日工资为6000元除以26天；如果雇主让月嫂在这3天放假，则月嫂应在月底顺延工作3天，保证月服务工作日达到26天。”

　　3倍日工资不会催高月嫂价格
