许霆诉银行一审被判“滥用诉权” 不服将上诉|诉权|滥用|许霆_新闻资讯

　　南方日报讯 (记者/刘冠南 通讯员/岳岩) 昨日下午，广州市越秀区法院对许霆诉银行查看对账单的存款合同纠纷一案，作出裁定。一审以“滥用诉权”为由，从程序上裁定驳回许霆起诉。

　　曾经因ATM取款机故障而盗取17.5万元的许霆，于2012年5月21日服刑完毕。今年7月4日，许霆到涉案银行要求打印交易账单，遭到拒绝，8月16日，许霆到广州市越秀区法院起诉，要求银行向其提供开户至今的银行账户明细对账单。10月25日，法院公开开庭审理了此案。

　　越秀法院审理认为，许霆在明知账户记账记录出错的情况下，仍提起本案民事诉讼，要求被告向其提供从开户至今、唯一、正确、真实、合法、有效的明细对账单，是滥用民事诉权的行为，有悖于民事诉讼应当遵循的诚实信用原则。而且，《账户流水清单》作为刑事证据之一，已经刑事诉讼审查认定和使用，对其内容，许霆也是明知的。因此，许霆主张要求银行提供从其开户至今的银行账户明细对账单的诉讼请求，不属于人民法院受理民事诉讼的范围。依照《中华人民共和国民事诉讼法》的相关规定，裁定驳回原告许霆的起诉。

　　裁定结果公布后，记者电话采访了许霆，他表示自己不服一审裁定，将要上诉。
