人民网北京12月5日电(刘茸) 云南“官员强奸幼女案”的受害人代理律师、云南冰鉴律师事务所律师陈维镖于今日晚间向记者确认，已收到大关县法院通知，该案将于明日下午3时公开宣判。届时，受害人家属及其代理律师、被告大关县机构编制委员会原办公室主任郭玉驰及其代理律师可能都将到场，法院也将就此召开新闻发布会。
陈维镖表示，他估计最终量刑可能在7-9年之间。这一结果比一审判决的有期徒刑5年量刑更重，但未达到被害人律师希望达到的“10年以上”量刑。
事件回放
今年8月24日晚间，大关县公安局翠华派出所接到报警称，一名2009年出生的女童可能遭到性侵犯。公安局侦查发现，嫌疑人为时任大关县机构编制委员会办公室主任的郭玉驰。
次日，郭玉驰被刑拘，同时被停职，3日后确认批捕，紧接着被免职。

一审经纬
一审中，受害方提出，要求被告人郭玉驰承担医疗费2000元，住宿费1000元，误工损失18500元，精神损失费80万元等在内的共计85万余元的经济损失。
9月24日，云南昭通市大关县法院对该案进行一审宣判，以强奸罪判处被告郭玉驰获有期徒刑5年，而由于原告无法证明其经济损失情况，判处被告不承担民事赔偿责任。
昭通市检察院认为，这个结果“量刑明显不当”，并提出三条抗诉理由：一审判决未根据刑法“奸淫未满14岁幼女应从重处罚”的原则对被告从重处罚；被告人作案动机卑劣，主观恶性深；被告系国家公务人员，其犯罪行为严重违背了国家工作人员的道德操守，严重损害了国家机关的形象，造成了恶劣的社会影响。
在检察机关抗诉之后，案件被上级法院发回原法院重审，期间双方民事和解，郭玉驰赔偿了受害人15万元。因此，二审的主要目的，就是重新确定被告郭玉驰的量刑。
