　　专家称要扭转“改革在前，立法修法在后”局面

　　昨日，李克强主持召开国务院常务会议，就进一步落实审批制度改革作出部署。会议讨论通过了修改公司法、海关法、药品管理法等7部法律的修正案草案，决定经进一步修改后，将提请全国人大常委会审议。

　　会议还审议通过了对进出口关税条例、城镇土地使用税暂行条例、著作权集体管理条例等16部行政法规作出了修改的决定草案。

　　会议指出，改革和发展要更多依靠法治推动，法治也要根据改革发展的要求不断完善。新一届政府取消和下放了一大批行政审批等事项，要按照及时跟进、审慎稳妥的原则，加快推进相关现行法律法规的修订。

　　“改革的既有成果用法律法规的形式固定下来，从而避免受到政策、人事等因素的影响，此举传达出积极意义。”中国人民大学商法研究所所长刘俊海教授接受《第一财经日报》记者采访时说。

　　不过，在10月30日公布的十二届全国人大常委会立法规划中，提上日程将修改或立新法的68件法律草案中并没有包括《公司法》修改。刘俊海认为，“国务院此次提出修改《公司法》，提请全国人大常委会审议，推进改革的态度鲜明。”

　　“改革与‘变法’要同步推进。”刘俊海说，回顾我国改革历程，通常是改革在前头，立法修法在后面，这个局面需要扭转。在深化改革的过程中，立法要发挥更大作用，为改革护航、鸣锣开道并扫除障碍。

　　昨日的会议称，要通过修订以上法律法规，使今年以来推出的完善生产经营活动许可及资质资格认定、取消和下放行政审批、严格事中事后监管、优化审批流程等改革措施在法律层面得到落实，简政放权、放管并重，进一步激发市场和社会活力，让各项改革在法律的保障下顺利推进。
