民政部回应设立弃婴岛：专家建议在全国推行|民政部|弃婴|儿童_新闻资讯

　　中新网12月5日电 国务院新闻办今日召开发布会，介绍深化改革促进民政事业发展等情况。会上，民政部副部长窦玉沛谈到了“弃婴岛”设立问题，他表示，设立弃婴岛，正是基于生命至上、儿童权益优先的原则为出发点，与中国未成年人保护法的立法精神是一致，与刑法打击弃婴犯罪并行不悖。

　　窦玉沛表示，关于困境儿童救助，民政部门一直在不懈努力。他举例表明：2010年国务院办公厅出台了关于加强孤儿保障的意见，将所有的孤儿纳入到国家保障，其中集中供养的一般每人每月1000元，分散供养的每人每月600元，我们保障了57万多孤儿。第二，在2011年，国务院办公厅又出台了关于加强和改进流浪未成年人救助保护的意见，把流浪儿童纳入到国家救助保障的范围。第三，在2012年，民政部又会同财政部发出通知，将受艾滋病感染的儿童参照孤儿纳入到国家的保障制度。

　　窦玉沛坦言，尽管我们做了不懈的努力，还有一些困境儿童没有纳入到保障的范围，还在采取低保制度来救助，标准相对偏低。下一步民政部正在做几件事：

　　第一、要积极争取将事实上无人照顾的儿童纳入到国家保障范围中来。无人抚养的儿童主要是指父母一方死亡，另一方放弃了监护责任，俗话说的“爹死娘嫁人”的现象，或者父母一方服刑，另一方离异，放弃对儿童的监护责任等等。这部分人也生活在困境中，急需要社会的保障。民政部争取把这部分孩子纳入到国家的保障中来。

　　第二、积极探索完善儿童福利制度。民政部已经在河南的洛宁、江苏的昆山、浙江的海宁、深圳等地进行适度普惠型儿童福利制度的试点，在试点的基础上，力争能够制定这方面的法规。

　　第三、积极探索推进儿童保护制度，主要的思路一是要整合制度资源，将现有的家庭保护、学校保护、司法保护、社会保护的各方面政策法规进行整合，为建立这项目制度提供法律依据。二是整合部门资源，形成横向到边的未成年人保护的部门联动机制。三是整合层级资源，形成纵向到底的儿童保护的网络。四是整合社会的资源，形成全社会关爱儿童的保护体系。从而构建一个对于儿童遇到困境时的发现、预防、监测、报告、转介和处置的机制，有效地避免了儿童在遇到困境时得不到救助的情况。

　　窦玉沛强调，深圳设立弃婴岛的问题，事实上早在2011年6月，石家庄市就设立了孤儿岛，在这期间民政部和有关部门请国内外的专家学者、实务工作者、社会组织的代表进行了认真反复的论证，形成了共识，专家学者们建议在全国推广。

　　窦玉沛称，弃婴问题是古今中外概莫能外的一种社会现象，许多国家建立了安全港、弃婴保护仓、匿名生产法等方式来收留保护这些婴儿。在中国，遗弃婴儿属于违法行为，也为社会道德所不容。遗弃婴儿的父母或者其他人员在遗弃时就选择比较隐蔽的方式和不易被发现的地点，这样使孩子因为不能被及时发现造成死亡，使一些本来就有病的孩子因为得不到及时的救助病情加重，有的终身都难以治愈。

　　窦玉沛进一步表示，昨天早晨，北京通州发现了一例弃婴，发现时腿还能动，等救治人员到了之后就已经死亡了。所以说设立弃婴岛，正是基于生命至上、儿童权益优先的原则为出发点，与我国未成年人保护法的立法精神是一致的，与刑法打击弃婴犯罪也是并行不悖的。
