  人民网北京12月4日电 (宣妍)日前,北京市住建委、市工商局和市公安局三部门联合约谈链家、我爱我家等20家房地产经纪机构引起了极大关注。人民财经调查发现,克扣押金是租户投诉最多的问题之一,为克扣租户押金,房地产中介机构花样百出,租户叫苦不迭。


  霸王条款只能一年一签 住不满就扣押金


  “中介说就算我们搬走了,也要把下一个季度的房租交了。”听起来有点荒唐的要求,却实实在在发生在家住胜古南里的租户盛女士身上。据盛女士投诉,自己和爱家地产签了一年合同,合同到期时间是2014年3月。因为合同中有条款规定,合同期内租户退租需提前一个月告知中介公司,并配合中介招租,否则中介将不退还租户押金,并以押金充当违约金。


  盛女士表示,她已经按照合同规定提前一个月告知中介,不算违约。“按照中介的说法,合同没到期不住了,就得立马搬走,即使你还有20多天的房租也不行,要不就只能继续住,把下个季度的房租一起交了。我们现在不得已又续租了,很郁闷。”


  常年租房的林先生表示,租中介的房子都要求一年一签,这本来就是霸王条款,如果不想中介以“违约”名义克扣房租和押金,就只能乖乖住完一年,否则就只能等待“被宰”。


  为扣押金 中介报天价水费


  曾租住在魏公村8号院3号楼的冯先生说,自己今年9月份租房到期后,长远天地房地产经纪有限公司以还有8000元水费未结清为由拒绝退还押金。“水费每个月我们都按时交的,如果未结清应该会停水,可是直到我们走的时候家里水都还没停。再者说,我们6个人居住时间就一年,怎么用也用不到8000元的水费。” 冯先生说。


  冯先生介绍说,在自己和中介理论后,对方表示一年8000元水费确实有点离谱,但这是物业给出的账单,公司正在和物业打官司,等官司赢了,就退还冯先生的押金。无奈之下,冯先生只好求助消协。“消协答应了调解,可是到目前三个多月了,中介都没给我打过一个电话。”


  人民财经致电该中介公司求证时,对方以不方便为由拒绝回复。


  人民财经了解到,不少租户表示,自己在退房时都遭遇离谱要求,克扣房租克扣押金甚至入屋清人的现象不在少数。有不少租户表示在遭遇侵权的时候向公安机关、消协等部门投诉根本解决不了问题。很多有过类似遭遇的租户表示被租房折磨得心力交瘁,谈中介色变。


  就目前房产中介乱象问题,人民财经致电北京天问律师事务所张远忠律师,张远忠建议,租户在和房产中介签合同的时候一定要仔细看清合同的条款,确保自己正当利益不被侵害,在遭遇黑中介不法行为的时候一定要保留证据,要通过法律途径维权,不可为了怕麻烦一味忍让,更不要“以暴制暴”。
