　　央广网西安12月1日消息(记者雷恺)　据中国之声《央广新闻》报道，陕西省人大常委会通过《陕西省建筑保护条例》，首次以立法形式明确规定，建成50年以上的重要历史建筑将认定为重点保护对象，如果该建筑被认定为文物保护单位或不可移动文物，便按照文物保护法律法规执行。

　　《条例》将建筑分为重点保护建筑和一般建筑。建成50年以上，并具备下列条件之一的建筑，可以认定为重点保护建筑：

　　(一)建筑类型、空间、样式、施工工艺和工程技术等具有建筑艺术特色或者科学研究价值的；

　　(二)反映本省历史文化和民俗传统，具有时代特征、地域特色的；

　　(三)在产业发展史上具有代表性的作坊、商铺、厂房和仓库等；

　　(四)历史名人故居、旧居；

　　(五)其他具有历史、科学、文化、教育、艺术价值的。

　　同时，获得国家级建筑行业优秀奖项，并具备前两项规定条件的，可以认定为重点保护建筑。

　　《条例》规定，县级以上政府对已经确定公布的重点保护建筑，应当每年定期发放保护补助费。设区的市、县(市)房产管理行政主管部门督促和指导重点保护建筑的修缮、保养。

　　重点保护建筑不得擅自迁移、拆除。确因城市基础设施建设和保护管理等特殊需要，无法实施原址保护的，应当由设区的市、县(市)城乡规划主管部门提出迁移、拆除或者复建方案，经专家委员会评审后报设区的市人民政府批准实施。
