　　[记者]您刚才提到社区矫正的问题，但现在也有一些人担心劳教制度废除之后，社区矫正会不会成为另外一种劳教呢？您怎么看待这个观点？

　　[赵大程]这种观点我看可能是一种模糊的或者是不太理解我们现在的有关制度所产生的。应该说，社区矫正和劳动教养区别点很清楚。社区矫正是刑罚执行的一个组成部分，它的法律依据，它的适用范围、运用的程序、执行的方式，都和劳动教养有着不同。社区矫正，我们依据的是刑法和刑事诉讼法等法律的规定，它所适用的范围、对象，就是我刚才讲的这四种人，就是法律判决他是管制的、宣告缓刑的、假释的或者被暂予监外执行的。而劳教是有违法行为，但是又不构成犯罪的，采取的一种强制教育的措施，所以是有区别的。再有，管理的方式是不同的，社区矫正是把社区矫正的对象放到他的家庭，放到他所熟悉的社会环境当中，就是两个不脱离，不脱离他的家庭，不脱离他所熟悉的社会环境，然后对他进行思想教育，对他进行生活的帮扶，这样让他能够感受到专门工作的力量对他的教育和家庭社会对他的感化教育。而劳动教养相对来讲是把刚才我说的是违法的但是没有构成刑事处罚的人员进行集中管理。所以他们的区别点是非常明显的，两个制度是不能混同的，更不可能出现刚才你所讲到的这样一种猜测。
