  晨报讯(记者 王萍) 十八届三中全会精神中央宣讲团成员、国务院法制办副主任袁曙宏,昨日在《光明日报》发表署名文章《深化行政执法体制改革》。文章指出,我国大约80%的法律、90%的地方性法规和几乎所有的行政法规都是由行政机关执行的,深化行政执法体制改革是保障人民群众权益、实现社会公平正义的迫切要求。深化行政执法体制改革面临六大主要任务,其中就包括“严格行政执法人员管理制度”,改革方向包括严禁未取得执法资格的人员执法,将合同工、临时工坚决调离执法岗位。


  受编制数影响,目前在城管等行政执法任务较重的部门,仍聘有较多“协管员”。按要求,协管员负责协助行政执法人员发现情况、口头制止纠正、配合执法取证等,不具有单独执法和处罚权力,但实际操作中,仍存在部分协管员“越界”和“越权”现象。袁曙宏在文中指出,行政执法人员素质高低,直接决定行政执法质量。要严格执法人员持证上岗和资格管理制度,对行政执法人员进行一次全面清理,未取得执法资格的人员不得从事执法工作,对被聘用履行行政执法职责的合同工、临时工,应坚决调离行政执法岗位。健全纪律约束机制,狠抓执法纪律和职业道德教育,加强执法人员思想作风建设,全面提高执法人员素质。定期组织行政执法人员参加通用法律知识培训、专门法律知识轮训和新法律法规专题培训,提高他们运用法治思维和法治方式解决执法中突出矛盾和问题的能力。逐步推行行政执法绩效考核制度,科学合理设计考核指标体系,考核结果作为执法人员奖励惩处、晋职晋级的重要依据。


  袁曙宏说,土地征用、房屋拆迁、环境保护等引发纠纷甚至群体性事件,往往由执法机关不按程序办事或程序不规范造成。对此,他提出制定具体执法细则、裁量标准和操作流程,做到步骤清楚、要求具体、期限明确、程序公正;推行行政许可、非许可审批标准化管理,并健全行政执法调查取证、告知、听证、集体讨论决定、罚没收入管理、执法争议协调等制度。同时,制定执法自由裁量权行使规则,对执法自由裁量权予以细化、量化和严格规范,并公布执行。


  袁曙宏还指出,需加强财政对执法经费的保障,并严禁下达或变相下达罚没指标,严格执行罚缴分离,“对下达或者变相下达罚没指标、违反罚缴分离规定以及将行政事业性收费、罚没收入与行政执法机关业务经费、工作人员福利待遇挂钩的,要依法对直接负责的主管人员和其他直接责任人给予处分。”
