　　人民网海南视窗海口11月11日电(记者吉羽) 由于海南福安南农贸市场管理服务有限公司没有在11月10日前，对“福安农贸市场”建筑物属于违法建筑提出听证、陈述及申辩请求。当天，海口市美兰区城管局依法对“福安农贸市场”下达《行政处罚决定书》，责令当事人于2013年11月14日前自行拆除该临时建筑，如逾期不拆除，该局将强制拆除。

　　海口美兰区城管认定，当事人海南福安南农贸市场管理服务有限公司于2012年8月未取得《建设工程临时规划许可证》，在南至福安小学门口，北至夏威夷花园，南北向长约230米，东西向长约24米的规划路土地上，建设2栋2层的临时建筑，建筑面积约4500平方米。

　　当事人的违法行为，已违反《中华人民共和国城乡规划法》第四十四条的规定，依照《中华人民共和国城乡规划法》第六十六条、第六十八条的规定，作出上述处罚决定。

　　当事人如不服此次处罚决定，可以按照相关规定申请行政复议，对行政复议结果不服，可按规定向法院起诉。行政复议和行政诉讼期间不停止本处罚决定的执行。(法律另有规定的除外)
