　　专家建议修改《继承法》 明确“口头遗嘱”失效时间 同时——

　　录像遗嘱应合法化

　　法制晚报讯(记者 汪红 实习生 梅双) 《继承法》应当将录像遗嘱列入遗嘱形式的范围，以与《民事诉讼法》保持一致。10月26日，龙翼飞教授在北京市法学会民商法学研究会上提出，应完善现行《继承法》。

　　中国人民大学龙翼飞教授介绍，我国现行《继承法》于1985年颁布，由于制定于计划经济时代，受到立法技术上的局限，使得立法过于原则化，现在应该与时俱进。

　　现在人们能够非常方便地使用各种电子设备来记录事件，并制作成音视频资料，而视频更能全面地反映遗嘱人的真实意志。《民事诉讼法》已经将“视听资料”列为证据类型的一种，因此《继承法》应当将录像遗嘱列入遗嘱形式的范围。

　　此外，《继承法》还应确认采用打印方式制成的书面遗嘱的效力。对自书遗嘱和代书遗嘱的书写方式，除用手写方式外还应允许立遗嘱人采用打印成纸质的方式，当然要本人亲笔签名，并注明年、月、日。

　　龙翼飞教授提出，口头遗嘱的使用范围须进行规范。现行《继承法》规定口头遗嘱须在“危急情况”下使用，而未明确规定“危急情况”的具体种类，以至司法实践中对“危急情况”的认定标准难掌握。另外，也没规定口头遗嘱失效时间。

　　建议《继承法》可以具体规定，如自然人在遭遇自然灾害、战争、重大交通事故等情况下，又无法用公证、自书、代书或录音录像形式设立遗嘱的，可以设立口头遗嘱。口头遗嘱应当有两个以上的见证人在场见证，由见证人制成书面记录，注明年、月、日，并由见证人签名。

　　前述“危急情况”解除后，自遗嘱人能够用其他方式立遗嘱之日起，经过30日，口头遗嘱失效，以便提高设立口头遗嘱规则的可操作性。
