  老物业公司(盛唐物业)为何会阻拦新物业公司(同涞物业)入驻并引发冲突呢?

  早报记者走访调查得知,该小区建立之初,开发商将大唐盛世花园小区委托盛唐物业管理,期限明确约定“自2006年5月1日起至业委会成立为止”。

  小区业委会2013年1月31日备案成立,之后并未和盛唐物业签订新的服务合同,不过小区仍由盛唐物业提供事实服务。去年9月1日,小区业主大会通过投票,决定公开招标选聘新的物业。最终具备一级资质的上海同涞物业公司中标。

  双方争议就此产生,盛唐物业称,业委会招标选聘新物业程序不符合规定,并将业委会告上法庭。

  2013年11月19日,浦东新区人民法院一审判决,驳回原告的诉请。对于业主大会决议程序是否合法,应否予以撤销,法院认为“系属小区业主撤销权范围,原告无权以决议程序违法为由请求继续履行前期物业管理合同”。原告诉请被告继续履行前期物业合同,缺乏事实及法律依据,法院“不予支持”。

  但对于法院的一审判决,盛唐物业不服,向上海市第一中级人民法院提起上诉。小区门外的法院传单显示,二审开庭时间是2014年1月14日9时。盛唐物业2013年12月30日在小区张贴告示称,“部分业主多年累计欠缴物业费达600余万元,现正在诉讼和催缴中,在财务账目结清前,我司无法移交。在法院尚未确认物业服务合同是否解除的前提下,贵会(业委会)组织同涞物业公司强行入驻小区的行为是违法行为。”

  昨晚,桑塔纳轿车司机已经向警方投案自首。

  业委会招标遭老物业起诉

据了解,位于浦东新区樱花路801弄的大唐盛世花园(一、二期)由开发商盛唐置业有限公司开发,建筑面积22万多平方米,有业主1598户,且两个小区为同一家物业公司。

  负责提供前期物业服务的为盛唐物业管理有限公司,按照前期物业合同的约定,委托管理期限自2006年5月1日起至业委会成立为止。

  昨日下午,据大唐盛世花园(一、二期)业委会蔡姓主任介绍,业委会于2013年1月31日备案成立,但之后并未和盛唐物业签订新的服务合同,不过小区仍由盛唐物业提供事实服务。去年9月1日,小区业主大会通过投票,决定公开招标选聘新的物业,却因此遭致盛唐物业的法律诉讼。

  蔡主任称,当时参与投标的有4家物业公司,最终具备一级资质的上海同涞物业公司中标。而业委会还曾公开邀请过盛唐物业参与竞聘,尽管其资质不够。“按照我们小区的规模,物业管理公司应该具备一级资质,盛唐只有三级资质。”

  据新民网报道,同年9月,盛唐物业以业主大会程序不符合“双过半”的规定为由,将业委会告上法庭。原告认为:被告组织的业主大会会议“参加的业主在专有面积占建筑物总面积上未达半数,人数也未达总人数的半数”, “违反了法律规定的业主大会决议的最低标准,侵犯了原告的合法权益,依法应为无效,被告应立即停止招投标选聘物业管理企业行为”,请求法院“判令被告继续履行前期物业管理合同”并承担诉讼费用。

  浦东新区人民法院先后两次开庭。经调查,开发商将大唐盛世花园小区委托盛唐物业管理期限明确约定“自2006年5月1日起至业委会成立为止”。法院认为,“当事人约定合同期限的,期限届满时合同权利义务终止”。关于这一点,原、被告双方都表示无异议。前期合同还约定,“合同期满或小区业主委员会对此合同有异议时,本合同自然终止”。

  物业不作为?业委会谋私利?

本以为法院判决下来,交接事宜能够顺利进行。但不料昨日零点刚过,同涞物业按照合同列队准备进场时,却遭到盛唐物业的阻拦,双方进而发生剧烈冲突。

  昨日下午,同涞物业相关负责人称,在2013年12月23日召开的房办会议上,作为盛唐物业的一名代表曾表示:双方交接时可能不会那么顺利。“为此我们列队的工作人员入驻时都拿着盾牌。”

  针对盛唐物业对业主大会的质疑,业委会蔡姓主任昨日表示,2013年9月1日召开业主大会时,他们共送达1585票,回收670张选票,910张未能回收。在这670张有效选票里,400多张同意更换新物业,200多张同意续聘。根据相关规定,没有投票或者弃权的视为同意有效选票里多数人的意见。“我们是一家一家敲门,敲门两次后无人应答便送至信箱。”

  而至于想要更换物业公司的根本原因,蔡主任说了许多盛唐物业不作为的地方,比如小区绿化搞得一塌糊涂,居民家里漏水报修不处理,私刻业委会公章以及物业称因为亏损将停车费、广告费等公共收益资金花光等。并且,早在2013年5月,业委会曾聘请第三方审计公司对物业账目进行审计,最终发现有近200万元资金对不上账,为此与物业交涉时也一直未得到有效答复,双方关系至此破裂。

  面对业委会的说法,盛唐物业的一名保安反驳称,业委会成立后因为顾及一方私利才要更换物业公司,很多业主并不知情。而他此前听闻业主拖欠公司物业管理费等600万元,业委会成立后让公司动用80万元购买办公电脑等用品,盛唐未答应从而令对方耿耿于怀。

  根据该名保安的说法,昨日凌晨新物业公司来了200多号人,拿着一米长的铁棍戴着钢盔,而他们只有二三十个人,且都是50后、60后的“老年人”。除了同涞物业的工作人员,还有外面雇佣的保安以及打手,“冲过来就围着车一顿打砸,我们也有多人受伤,有人额头缝了7针。”

  不过,盛唐小区居委会书记在接受采访时,从旁证实了业委会的成立绝对合理合法,其他细节则不愿回答更多。

  服务不满意为什么不能换

  昨日15时30分,大唐盛世花园二期小区南门附近,同涞物业近30名工作人员列队走出,先后进入盛唐花园二期、一期小区,顺利地完成了工作交接。聚集在南门的小区业主有人自发鼓掌,也有人表情异样。而正在值班的上海盛唐物业管理公司的员工则收拾个人物品离开。

  对于此次新老物业更换,小区里的居民也有不同声音:一部分居民表示平日对老物业的工作还是比较满意的,其他则不太清楚。

  而有一位业主在采访中则说:“物业管理是服务性合同,服务不满意我们为什么不能更换?现在小区里垃圾没人倒,楼梯里到处有人张贴,治安也不安全,我们怎么会满意?本来我们业主是小区的主人,现在物业要骑到我们头上,不行。”

  针对有业主称自己对更换物业公司从头到尾毫不知情,蔡主任表示,业委会的通信渠道一直没有资金建设,而每每张贴的公示都被人撕毁,其后在微博和论坛都想了办法,可还是有诸多限制。他说业委会目前只有9个人轮流工作,面对1600户,要做到一一告知实在有难度。

  据了解,事件发生后,同涞物业公司相关负责人第一时间到医院和死者家中慰问,并开始后续安抚工作。昨日20时许,上海浦东新区大唐盛世花园一期、二期小区的部分业主自发聚集在二期小区南门,点亮蜡烛,为受伤的物业员工祈福。
