农民工讨薪能不能申请法律援助?遭受家庭暴力能不能申请法律援助?哪些人可以申请法律援助?怎样申请法律援助……这一切的疑问现在都能在《重庆市法律援助条例修订草案》中找到答案。
《法制日报》记者近日从重庆市四届人大常委会第六次会议获悉,《重庆市法律援助条例修订草案》首次提请审议,修订草案扩大了法律援助的范围,适当调整了法律援助的经济困难标准,同时进一步补充完善了援助程序,并从制度层面对法律援助案件质量作了相应规定。
此外,修订草案还明确农民工、残疾人、未成年人、老年人、妇女等合法权益遭受侵害时,可以申请法律援助。见义勇为主张民事权利、交通事故、医疗纠纷请求赔偿等也可申请法律援助。
法律援助范围扩大
《重庆市法律援助条例》自2004年9月1日起实施,至今已近十年之久。现行条例曾经在保障公民享受法律服务权利,维护社会公平正义方面发挥了积极作用,但随着经济社会的发展,现行条例已不能适应新形势需要。
修订草案依据法律和有关政策规定,对法律援助范围、经济困难标准、援助程序等进行了调整。
在法律援助范围上,修订草案按照民事(经济困难)、民事(非困难)、刑事(经济困难)、刑事(通知辩护)等四个方面,对法律援助的范围进行了全面系统的规定。
修订草案新增的可以申请法律援助的情况包括:请求支付劳动报酬和工伤保险待遇的;遭受家庭暴力、虐待、遗弃的;土地成本经营权流转中合法权益受到侵害的;交通事故、医疗纠纷中合法权益受到侵害请求赔偿的;未成年人、老年人、妇女合法权益受到侵害的;市人民政府规定因经济困难可以申请法律援助的其他情形。
修订草案同时新增规定,公民有以下情形之一的,可以申请法律援助:因见义勇为行为主张民事权益的;农民因使用假冒伪劣生产资料(种子、农药、化肥等)等请求损害赔偿的;农村进城务工人员请求支付劳动报酬和工伤保险待遇的;未成年人合法权益受到侵害且侵权人为其监护人的;残疾人合法权益受到侵害的;市人民政府规定申请法律援助无需审查经济状况的其他情形。
此外,针对刑事诉讼中犯罪嫌疑人、被告人是残疾人的情形,修订草案也作了相应规定。
草案规定,有证据证明犯罪嫌疑人、被告人属于一级或者二级智力残疾,没有委托辩护人的,可以申请法律援助;犯罪嫌疑人、被告人是盲、聋、哑人,或者尚未完全丧失辨认或控制自己行为能力的精神病人,没有委托辩护人的,可以申请法律援助。
法律援助程序完善
关于法律援助的程序,修订草案作了进一步的补充和完善。
修订草案对法律援助申请人作了补充和完善,明确规定,申请法律援助,由当事人向法律援助机构提出;被羁押的犯罪嫌疑人、被告人、服刑人员和强制隔离戒毒人员申请法律援助的,可以由其法定代理人、近亲属代为申请。
法律援助应该到哪儿去申请呢?
修订草案规定,申请法律援助的事项属于诉讼事项的,向有管辖权的人民法院所在地的法律援助机构提出;属于侦查或者审查起诉阶段刑事案件的,向办理案件的公安机关或者人民检察院所在地的法律援助机构提出。申请法律援助的事项属于非诉讼法律事务的,向有权处理机关所在地、申请人住所地或者所请求人住所地的法律援助机构提出。申请人对法律援助机构无法确定的,可以请求市司法行政部门确定。
修订草案对申请援助的材料也作了规定,规定申请法律援助需要提交法律援助申请表、身份证明、经济困难证明以及其他与申请援助事项有关的案件材料。
修订草案规定,法律援助机构收到法律援助申请后,应当进行审查,并在七个工作日内作出准予或者不予法律援助的决定,并书面通知申请人;申请材料不全或者不符合要求的,应当一次性告知申请人应当补交的材料,对证件、证明材料需要核实的,应当在五个工作日内核实。申请补充材料和法律援助机构核实证件、证明材料的时间不计入审查时限。
对于一些特殊情形,法律援助机构可以先提供援助再进行审查。
修订草案规定,距法定时效届满不足七日,需要及时提供诉讼或者申请行政复议的;需要立即申请财产保全、证据保全或者先予执行的;其他紧急或者特殊情况都可以先进行法律援助,再进行审查。
保证法援案件质量
为了保证法律援助案件的质量,修订草案对法律援助机构和人员的责任和义务作了制度化规定。
修订草案新增规定,法律援助人员应当依法办理法律援助事项,忠实履行法律援助职责,全力维护受援人的合法权益;法律援助人员应当接受法律援助机构的指导和监督,同时,保守法律援助事项所涉及的国家秘密、商业秘密和当事人隐私。
修订草案还新增规定,法律援助人员不得利用办理法律援助案件收取受援人及其亲属财物或者牟取其他不正当利益。未经法律援助机构批准,法律援助人员不得终止法律援助,不得委托他人办理指派的法律援助事项。
修订草案规定,法律援助人员依法查询、复印有关资料的,有关国家机关、社会团体、企事业单位以及其他组织应当提供支持,不得收取查询费用,复制资料收费不得高于社会经营机构的同类收费;人民法院受理的法律援助案件应当缓收、减收或者免收案件受理费;受援人申请仲裁、公证、司法鉴定的,有关仲裁机构、公证机构、司法鉴定机构应当依照有关规定缓收、减收或者免收有关费用。
对于法律援助服务机构及其法律援助人员违反有关规定办理或者拒绝办理法律援助案件的;收取受援人财物的;泄露法律援助事项所涉及的国家秘密、商业秘密和当事人隐私的,修订草案规定,由司法行政部门给予警告、责令改正;情节严重的,给予一个月以上三个月以下停业整顿的处罚。
修订草案还规定,法律援助机构及其工作人员办理法律援助案件收取的财物,由司法行政部门责令限期退还;从事有偿法律服务的违法所得,由司法行政部门予以没收;侵占、私分、挪用法律援助经费的,由司法行政部门责令限期追回;克扣法律援助办案补贴的,由司法行政部门责令限期足额支付。
