　　新京报快讯（记者王梦遥）记者今天从最高法获悉，最高人民法院近日下发《关于加强和规范人民法院国家司法救助工作的意见》，意见规定，“因案致贫”最高可获36个月平均工资的司法救助。

　　按规定，人民法院在审判、执行工作中，对权利受到侵害无法获得有效赔偿的当事人，符合规定情形可以采取一次性辅助救济措施，以解决其生活面临的急迫困难。

　　什么情况下当事人可以提出国家司法救助申请？意见共规定了8种情形，包括刑事案件被害人受到犯罪侵害，造成重伤或者严重残疾，因加害人死亡或者没有赔偿能力，无法通过诉讼获得赔偿，陷入生活困难的；刑事案件被害人受到犯罪侵害危及生命，急需救治，无力承担医疗救治费用的；刑事案件被害人受到犯罪侵害，致使其财产遭受重大损失，因加害人死亡或者没有赔偿能力，无法通过诉讼获得赔偿，陷入生活困难的。
