记者调查发现,赵国军等人所采取的这种手段,已被北京市房产中介市场的众多黑中介普遍采用,成为一个“行业骗局”。因为黑中介收租、欠租后人去楼空,无从寻找,至少有数百位房主、租客采取投诉、报案、诉讼等方式进行维权,但挽回损失却遥遥无期。
虽然房管、工商直至司法部门多方监管,但这样“行业骗局”仍成整个管理体系中的一块灰色地带。相关监管部门表示,对于非法经营的房地产经纪公司,彻底取缔存在难度。

警方调查发现,由赵国军及其属下把控的多家中介机构,骗租房主房屋后打隔断出租,敛财后再以变更公司和法定代表人等逃避追责。
“黑中介教父”的发财路

赵国军“背着手”的动作,在房东窦雅兰看来有些眼熟。去年6月10日,赵国军来租她的房子时,也是背着手在空房里看了一圈,当时他租房的理由是“为了让孩子上学方便”。
窦雅兰回忆,赵国军说话时并没有看她的眼睛,神情显得很着急,“我说不急着签合同,先把房子收拾收拾,但他立刻摆手说‘不用不用’,他想自己装修。”
在双方随后签订的合同里明确约定:“不得擅自改变房屋结构”、“未经同意不得将房屋转租给第三方”。

记者注意到,大多数受害者的经历与窦雅兰如出一辙,博雅兴业的手段近乎于是一种“行业骗局”。
1月8日,在房东断水断电3天后,小张最终放弃“抵抗”,从鹏润家园的出租房中搬了出来。此时,租给他房的中讯伟业房地产经纪公司(简称中讯伟业)还欠他1200元押金没有归还。
小张不忍心妻子和不到一岁的儿子受苦,他重新找了房子,让母子俩搬走。
去年12月底,小张的房东李常贵“催搬”半年无果,将电表的电卡更换,小张和屋里的租户们开始靠电表里仅剩的60多元钱度日。

在明远置地“消失”后,去年年底,一家名叫中和置地的房地产经纪公司(简称中和置地)的中介机构也人去楼空。多位与中和置地签订租房协议的房主及租客称,中和置地使用与博雅兴业类似的手段,改变房屋结构群租,扣押租客的房租。

多头管理下的投诉“困境”
房东租户多方投诉问题未得到解决,监管存在空白;多名受害者起诉,担心胜诉后难执行

1月15日,记者跟随一名房主前往丰台区房管局房屋租赁市场管理科反映情况。对于违规经营的房地产经纪机构的查处,一名工作人员表示,房管局对这样的机构只有处罚权,无权取缔非法经营的中介机构,工商部门才有权吊销其执照,“房管局发现中介存在违法行为,最高可处以3万元的罚款。”

对于工商部门对房屋经纪机构的监管范围,该工作人员表示,从事房屋买卖租赁的经纪机构需要到工商和住建委同时备案,工商备案的意义在于将经纪机构纳入监督管理,没有备案的,工商部门发现了只有督促其备案的监管权,没有处罚权。“如果中介公司没有营业执照,或者超过经营范围,才能由工商来处罚。”该工作人员称,群租、打隔断这些违规行为,只能由住建委查处。
警方的苦恼
博雅兴业被刑拘18人中16人被取保候审,赵国军涉嫌非法经营罪被批捕;民事行为与刑事犯罪界限模糊
警方查处博雅兴业后,很多遭遇类似经历的房主和租户将解决问题的出口指向公安部门。
1月15日上午,26名房主及租户前往北京市公安局信访,举报投诉涉及中和置地、万古乾、中讯伟业、鸿基嘉业等10家中介机构。
其中万古乾曾因群租、克扣押金,中讯伟业因群租,均在去年11月26日被市住建委列入黑名单,并被处以罚款。1月7日,记者从住建委执法大队了解到,上述10家公司中的一家正在被调查中,他们将收集资料后提供给公安部门。
对于举报的这些公司,当日接访民警答复,警方将进行甄别,“你们说的黑中介不都是有问题。”该民警称,房屋经纪机构由工商发给合法经营执照,是否合法经营,应该是谁发照谁查,查这些机构的有无资质不是公安机关职权,公安只负责这些机构在经营过程中的行为是否涉嫌犯罪。
该民警表示,北京市公安局刑侦总队已经关注到一些房屋经纪公司的违法犯罪行为,主管领导对此也有批示,正在全力办理,“这个事代表性很多,涉及面很广,每人涉及的金额并不大,但大多数人加在一起,代表的面较广,代表了一个行业的违法情况,这个事作为一个专题我们正在查。”
近日,有网友在北京黑中介维权的QQ群中提到,博雅兴业被刑事拘留的18人中已有16人被取保候审。
负责此案的一名刑警向房主证实此事,称主要嫌疑人赵国军和柳臣泽已被检察院批准逮捕。
“检察院以涉嫌非法经营对两人批准逮捕,没有按我们提请的涉嫌诈骗批捕。”该刑警表示,这是北京警方第一次以涉嫌诈骗抓捕黑中介人员,“很多区县的公安机关都在盯着这案子如何进展,如果能顺利按照诈骗进入公诉,那么其他区县的类似中介公司可能将会被打击。”
该刑警透露,其实早在去年9月,警方曾抓过赵国军一次,但最终释放。
赵国军供述,他手中有100多套房源,涉及各个区县,他专门咨询过律师和法院,他所从事的违规交易行为属于纯民事行为,构不成刑事违法犯罪,所以他才敢这样干。
警方在第一次抓捕赵国军时,也向法制部门了解此情况,得到的答复确实为商业欺诈,承担民事责任。
该刑警称,此次打击博雅兴业,很大原因是其造成的社会影响恶劣,受害人太多,市局认为其严重影响百姓利益,所以用了几个月时间调查赵国军,最终于去年12月9日收网。
审查中,赵国军称,他的手段也是从早期的黑中介公司那学来,学到手以后,他开始单干。为了逃避处罚,赵国军把控的所有公司均为其身边的亲戚朋友,“法定代表人吴凤岐是赵国军的姐夫,投资人申博香是其姐姐。”
对于赵国军是否能因涉嫌诈骗被公诉,该刑警不太乐观,“毕竟以前没有过,检察院已经按照非法经营批捕了。”
截至昨晚8时,丰台检方未透露对赵国军案的侦办情况。
